What is a Compromise Agreement?
A compromise agreement is a written contract signed by the employer and the employee. It accompanies the employer's offer to pay the employee, and in return the employee agrees not to make any claims against the employer.
Situations such as redundancy, or where a dispute has arisen between employer and employee may result in the employer offering settlement.
How Much Compensation?
The employer's offer of payment is called a compensation payment, termination payment or severance payment. The amount will depend on the reason for the termination and the way in which the termination has been progressed. It is important, therefore, that your solicitor identifies your legal claims because this will clarify the appropriate amount of settlement that you are due.
What Does it Cost?
If you have received a compromise agreement, then you will have to take independent legal advice before signing it. Your employer will make a contribution towards the cost of that advice - this will cover our legal fees (we will send our invoice to your employer, not to you).
